Civil and Criminal Law in Healthcare: Memorandum

In the healthcare sector, Human Resources (HR) professionals bear a multitude of responsibilities, ranging from personnel management to ensuring legal compliance. The healthcare industry encounters legal challenges on a daily basis, and the HR department plays a crucial role in navigating these complexities. It is essential for HR professionals to possess a comprehensive understanding of both criminal and civil law, enabling them to address risks that could impact the well-being of patients, employees, and the organization as a whole. When a healthcare organization faces a criminal act that jeopardizes patient safety, the repercussions can severely damage the organization’s reputation and lead to significant legal consequences. Conversely, healthcare also operates under civil laws, which encompass contracts, malpractice, and employment disputes.

This memorandum will focus on the incident involving Vila Health and a pediatric patient who was mistakenly administered the wrong medication. It will outline the civil and criminal issues that the organization may encounter as a result of this incident. The memo will analyze the legal implications of the situation and provide relevant organizational policies, laws, and regulations to prepare for an informed discussion with legal counsel. This discussion will aim to address the family’s concerns while safeguarding the organization’s legal interests.

Staff Protocol Interviews

The initial step for the facility is to have the ethics committee review the hospital’s policies and approach to medical error reporting to assess whether their methods are principled (Medical Ethics Advisor, 2011). Once this evaluation is complete, HR and management will conduct interviews with the doctor, nurse, and pharmacist who were present during the incident. Each healthcare professional will be asked about the standard protocols and procedures for administering medication to patients. The interviews will be conducted individually, allowing each staff member to explain their actions and responsibilities in the matter, including how the medication was ordered, received, verified, prepared, and administered.

This interviewing process will help identify who was involved and what steps were overlooked, providing insight into how the error occurred. It is vital that the questions posed assess the knowledge, training, and understanding of medication safety and dosage calculations among the staff. Additionally, the documentation and communication processes should be scrutinized to ensure that the medication order was accurately written, documented, and communicated among the team. Each individual’s specific roles and responsibilities, including verifying medication orders, preparing them, and administering them to the patient, should also be discussed. Finally, it is important to evaluate the factors that contributed to the error, such as distractions, heavy workloads, staffing shortages, or other circumstances that may have played a role in the incident.

Civil Issues Questions for Counsel

To address the civil implications of the incident, the following questions should be posed to legal counsel:

  1. Are there potential grounds for medical malpractice in this case?2. Can the incident be classified as negligence, and if so, what factors need to be established?3. What are the potential liabilities for the healthcare professionals involved, including the doctor, nurse, and pharmacist?4. Are there any potential claims related to emotional distress or psychological harm suffered by the patient and their family due to the incident?5. What are the legal implications if it is determined that the incident resulted from a systemic issue within the healthcare facility, such as inadequate training or flawed protocols?6. Can the organization be held vicariously liable for the actions of its employees in this case?7. What potential damages may the patient and their family be entitled to seek in a civil lawsuit?

Response to the Civil Law Issue

In this situation, Vila Health’s healthcare facility is confronted with a civil law issue characterized by negligence. Negligence is defined as a tort, which is a civil or personal wrong resulting from heedlessness or carelessness that deviates from the standard of care typically expected from reasonable members of society (Pozgar, 2020). The parties responsible for this negligence may include any trained healthcare providers who failed to deliver adequate care and meet the established standards. Medical negligence occurs when a healthcare provider does not offer treatment that aligns with the accepted standard of care, leading to adverse health effects for the patient, which can result in a medical malpractice claim (Berger & Green Attorneys at Law, 2023).

In this case, the administration of the incorrect medication caused the patient to experience adverse effects for five hours, potentially establishing grounds for a medical malpractice case. To substantiate a claim of medical negligence, the family must demonstrate that the healthcare provider had a duty of care, that this duty was breached due to negligence, that the patient was harmed as a direct result, and that the patient suffered damages due to the failure to meet the standard of care (Bieber, 2022).

Criminal Issues Questions for Counsel

To address the potential criminal implications of this case, the following questions should be posed to legal counsel:

  1. What criminal laws may be implicated in this case, considering the potential harm caused to the patient?2. Are there elements of recklessness or intentional misconduct that could contribute to potential criminal liability?3. What are the potential criminal liabilities for the healthcare professionals involved, including the doctor, nurse, and pharmacist?4. Have any specific criminal statutes or regulations regarding patient safety or medication administration been violated?5. What is the standard of proof required in a criminal case, and how does it differ from the burden of proof in civil cases?6. What potential defenses can be raised against criminal charges in this context?7. Are there any other potential criminal implications for the healthcare organization itself beyond the actions of individual healthcare professional?

Response to the Criminal Law Issue

Criminal negligence is defined as a reckless disregard for the safety of others, characterized by willful indifference to the potential for injury resulting from an act (Pozgar, 2020). According to Chapter 4, Criminal Aspects of Health Care, criminal negligence is present when there is a gross deviation from the standard of care expected from a reasonably careful person under similar circumstances, even in the absence of specific or general criminal intent, as illustrated in the case of State v. Brenner.

In this case, the healthcare professional who administered the medication to the child could be charged with criminal negligence if it is determined that the medication was given carelessly and recklessly. For a conviction of criminal negligence, the patient must have suffered serious harm or death. To establish that the healthcare provider should face criminal charges, the prosecutor must prove beyond a reasonable doubt that the healthcare worker’s actions constituted a gross deviation from the standard of care, demonstrating a wanton disregard for the patient’s safety. Depending on the severity of the patient’s injuries, potential penalties for criminal negligence could range from a misdemeanor charge with fines and probation to a felony charge resulting in prison time and substantial fines (Kehoe, 2023).

Conclusion

In conclusion, while healthcare providers strive to heal and assist their patients, mistakes can occur. When such mistakes lead to injury, the law permits the affected patient to file a lawsuit seeking compensation. In this instance, the inappropriate administration of medication appears to be an accidental error, which would likely warrant civil action rather than criminal charges. The patient’s family may pursue a negligence claim against the facility, the doctors, and/or other medical staff involved. The burden of proof in a negligence case rests with the plaintiff, who must demonstrate that the defendant owed a duty of care, breached that duty, and that this breach caused the plaintiff’s injury (Wex Definitions Team, 2023).
